4. What is the duty of care?

If you have waste, you have a legal duty of care to make sure that you look after it and that your waste doesn't cause any environmental problems or end up being fly tipped. To comply with the duty of care you have to:

  • Make your waste secure. Make sure containers are up to the job and that the waste won't leak or blow away.
  • When you pass your waste to someone else, make sure they are authorised to take it.
  • When you pass your waste to someone else you must complete and hand on a waste transfer note and keep a copy for two years.
